1 – Implementation and modification of the general terms of sale

The present general terms of sale apply to the promotion and to the sale of works of art and luxury by Passion-of-Time on the web site below called https://www.passion-of-time.com. 
They are available for the buyer on the homepage of the website https://www.passion-of-time.com.

Those general terms of sale are a translation of the French version, only for indication.

Every user of this web site declares having full legal capacity and being of age, which are the required conditions permitting to engage himself following these general terms of sale.
The buyer only needs to click on “General Terms of Sale” (below called G.T.S.) to know the terms of his order even before he began the process of command. The fact of placing an order implies the whole acceptance and without reserve of the buyer on these conditions. Except particular stipulations defined by a written statement between the parts, all orders are submitted by full rights to the present general terms of sale.
These general terms of sale can be modified without previous notice. The customer is invited to check regularly the general terms of sale during his visits on the web site and to accept them before each order confirmation.

All the clauses of the present general terms of sale, all the transactions and purchases made on the site https://www.passion-of-time.com as well as by mail or by phone are governed by the rights and the French law.
Any lawsuit which will not have found amicable arrangement will be within the competence of the court of Nanterre (92000) in France.

2 – Price

Unless otherwise mentioned, the indicated prices are in Euro all taxes included and without transport costs. With all reserve of mistake or omission. These prices include a VAT of 20.00% and all applicable taxes.
https://www.passion-of-time.com reserves the right to change its prices at any time.

3 – Order

https://www.passion-of-time.com commits to accept orders following the present general terms of sale while stocks last.
https://www.passion-of-time.com will treat every order by one or more deliveries of the ordered products in accordance with the products availability at order time.

To be valid, all orders must be done by internet and only on the site https://www.passion-of-time.com.
Every order will only be taken into consideration after payment acceptance and confirmation of our banking organism.

https://www.passion-of-time.com commits the right to cancel all orders or the not corresponding or doubtful deliveries as well as those of a member with whom there would be a dispute concerning the payment of a previous order.
The products and the proposed prices are valid while stocks last. In case of unavailability of one or several products after the order validation, https://www.passion-of-time.com will inform the customer by e-mail or by phone about the partial or total cancellation of his order.

In case payment would already have been debited of the member bank account, https://www.passion-of-time.com will proceed as soon as possible to the refund of the one or several not delivered products by re – crediting the credit card having been used the order payment.
https://www.passion-of-time.com will not be responsible for an eventual stock shortage which would entail a delay in the delivery of order.

4 – Payment

The payment of the goods is entirely made with order by credit card, bank transfer or bank check.
The number of the credit card is entered on our provider’s website.
The information is coded (SSL technology)
The credit card number is never completely printed on the payment ticket.
A request of authentification may be asked on-line by your Bank during the transaction of payment within the framework of the 3D procedures SECURE.
The validation of payment is effective after validation of the center of payment for the payment by credit card and by transfer, and after collection of the check in case of payment by check.
A letter must be joined to the payment by check, specifying your e-mail address as well as the number of your order.

5 – Right to retract

In application of the consumption code, the customer has a deadline of fourteen days from the delivery of his order to return the not wished products in good condition in their original packing to the concerned sender, for exchange or refund, without penalty, except for the expenses of return. In any case, the customer has to inform the sales department of his decision. The return costs will be taken in charge by the customer and only the price paid for the goods will be refund to the member by credit card or by check in a delay of 14 days.
The invoice must be joined to the goods return and will generate a credit note for a following order (except you ask for the payment restitution).

6 – Transport costs

The delivery will be made by La Poste or UPS.
A fixed participation for the packaging- and transport expenses will be automatically calculated regarding the ordered products.

7 – Delivery

The parts can be directly picked up at the Passion-Of-Time (Courbevoie – France – 92400) or can be sent by transporter La Poste or UPS as soon as the payment has been validated. The parts travel in wooden boxes or protected cardboard boxes especially adapted for transportation of antiquities and prehistoric parts.
In case of the delivery of a not corresponding product to the initial order, the customer will have the opportunity to contact the customer service to require to the correct delivery.

Orders placed within France are usually delivered in 3 to 4 days. Orders placed within Western Europe typically take up to 7 days and orders shipped to destinations outside Europe and to overseas departments usually arrive in 14 days.

Upon receipt of the goods, it is up to the customer to verify the state of the goods in the presence of the transporter and to make all the necessary observations in case of breakage, of damage or of missing, by expressing its reserves on the delivery note, and within 48 hours which follow the reception of the goods by registered letter with recorded delivery with the transporter (copy to Passion-of-Time).

The on-time delivery can only take place if the customer communicated to the seller the exact information of the address and phone number of the addressee. In case of error, Passion-of-time could not be held responsible for the impossibility to deliver the goods in place and on time.
Passion-of-Time could not be held responsible for possible delays in delivery attributable to the carrier.

Should you live in another country than France Metropolitan, customs duties or other local taxes either import duties or taxes of states may be required for your order. These costs will be chargeable to you and are of your full responsibility both in terms of statements and of payments to the authorities and to the competent organisms of your country. Inform yourself about these rights and taxes with your local authorities.

8 – Intellectual property

All the elements of the seller site, visual or sound, including in the indirect technology, are protected by copyrighted royalties, marks or patents.

They are the exclusive property of the seller. A customer who has a personal website and who wishes to place a link referring to the seller site for his personal use is under a strict obligation to require the authorization of the seller by writing him previously.
In any case, every not authorized link has to be taking back immediately after seller’s request.

9 – Confidentiality

The information collected on the interfaces of the site Passion-of-Time cannot be the object of communication, except legal obligation.

10 – Competent jurisdiction

The present general terms of sale are submitted to the French law. The contractual information is presented in French language and the proposed products for sale are in accordance with the French legislation. The court of Nanterre (92000 – France) is the only competent court for any dispute resulting of the application of the present general terms of sale without exclusion from any court referral by Passion-of-Time of another competent jurisdiction.

11- Responsability

Passion-of-Time has an obligation of means, however its responsibility cannot be committed in case of negligence of one of its obligations due to facts independent from its will (strikes, disasters, computing or material breakdowns, problems of connection to Internet).

12 – Acceptance of the buyer

The present general terms of sale as well as the prices of products sold on the site are expressly accepted by the buyer who declares and recognizes having been informed of them, and therefore, the member gives up taking advantage of any contradictory document, in particular, its own general conditions of purchase.
